Administrative Orders

The court entered 2 administrative orders on May 12, 2015.

Administrative Order 888 amends Local Rule 2016-2(d)(4)(B) and Local Form 3, effective June 1, 2015, to increase the presumptive non-base fee for a motion to modify a Chapter 13 plan from $350 to $450. The new version of Local Form 3 is available here in PDF format or here in Microsoft Word format and will be added to the court's Local Forms page on this website on June 1, 2015.

Administrative Order 889 amends Local Form 4 and Local Form 4A, effective June 1, 2015, to add provisions related to post-confirmation procedures in Chapter 13 cases. The new version of Local Form 4 is available here in PDF format or here in Microsoft Word format. The new version of Local Form 4A is available here in PDF format or here in Microsoft Word format. The new versions of Local Form 4 and Local Form 4A will be added to the court's Local Forms page on this website on June 1, 2015.

NCBJ Announces Blackshear NCBJ Presidential Fellowship Opportunities for the 2015 Conference in Miami Beach

The National Conference of Bankruptcy Judges began accepting applications for its Honorable Cornelius Blackshear Presidential Fellowship for minority lawyers who practice bankruptcy law on May 4, 2015. Click HERE for information about Judge Blackshear, the Fellowship criteria, the application form and other information about the program.

The fellowship program provides both waived conference registration ($949 value) and a stipend for reasonable travel/hotel expenses for five up-and-coming minority bankruptcy practitioners (with less than 10 years of experience) who wish to attend the annual meeting of the National Conference of Bankruptcy Judges and who otherwise meets the selection criteria. This year's conference will be held September 27 – 30, 2015 in Miami Beach at the Fontainebleau Miami Beach. To view this year's conference agenda, go to http://www.ncbjmeeting.org.

The submission period for applications runs until July 1, 2015. The application and supporting documents must be sent via e-mail to:

Judge Whitley's May 4 and May 5 hearing dates are rescheduled as follows:

May 4, 2015 (Chapter 11) rescheduled to May 12, 2015 at 9:30 a.m.
May 5, 2015 (Chapter 7) rescheduled to May 14, 2015 at 9:30 a.m.
The Court will renotice any hearings already set for May 4 and May 5.

Please Note:

Credit counseling and financial management courses must be completed through one of the approved providers for the Western District of North Carolina.  The list of approved providers is found under the “information” tab on the Court’s website or directly at
http://www.ncwba.uscourts.gov/credit.html.  Pursuant to 11 USC § 111, providers must be re-approved annually and may be removed at any time.
