Amicus Briefs

Amicus briefs have been invited in the case In re Rose, Case No. 12-40743, on the issue of whether the court has authority under the Bankruptcy Code and North Carolina state law to vest title to property in the name of a secured creditor at a Debtor’s or Trustee’s request and absent consent of that secured creditor.

Interested parties shall have until May 2, 2014 to submit briefs. The briefs should bear the proper case name and caption, but should be submitted to briefs@ncwd.net in Adobe PDF format with a maximum file size of 4MByte.

The construction of the new bankruptcy courtroom at the United States Courthouse in Statesville, North Carolina is nearly complete, and the court will conduct its first hearings in the new courtroom on May 8. Therefore, hearings currently scheduled to be conducted at the Johnson J. Hayes Federal Building in Wilkesboro, North Carolina on or after May 8, 2014 will be re-noticed by the court to reflect a hearing location at the United States Courthouse in Statesville. Please be advised that all notices of hearing for court dates on or after May 8 in the Wilkesboro Division should reflect the United States Courthouse in Statesville as the hearing location.

The Wilkesboro § 341 meetings in Chapter 7 and Chapter 11 cases originally scheduled for May 5 at the Johnson J. Hayes Federal Building in Wilkesboro will be conducted in the new bankruptcy courtroom on the 1st floor of the United States Courthouse in Statesville located at 200 West Broad Street.

Effective Monday, February 24, 2014 the Statesville Division Bankruptcy Clerk’s Office, located on the third floor of the U.S. Post Office Building, 200 West Broad Street, Statesville, North Carolina will open for walk-in customer service Monday, Wednesday, and Friday, 8:30 a.m. to 4:00 p.m. The office will close for lunch 12:30 p.m. to 1:30 p.m. For inquiries regarding Statesville Division customer service, please call 704-871-4280.

Please continue to mail all checks, money orders, and certified funds to the Charlotte Bankruptcy Clerk’s office for processing. (This includes Chapter 11 quarterly fees and installment payments.) Mail your payments to: U.S. Bankruptcy Court, 401 West Trade St., Room 111, Charlotte, NC 28202. Attorney filers may also submit credit card payments by using Pay.gov.

On December 1, 2013, amendments to two official bankruptcy forms, Schedule I and Schedule J, became effective. Historically, Schedules I and J were used when filing or amending schedules; however, as of December 1st, these forms may now also be used as a supplement to the initial filing. In accordance with this change, the Bankruptcy Court for the Western District of NC has created a new docket event for filing these schedules as a supplement. This docket event can be found in CM/ECF under Bankruptcy/Other/Supplement I/J.

Proposed Amendments to Rules & Forms

The Judicial Conference Advisory Committees on Bankruptcy and Civil Rules have proposed amendments to their respective rules and forms, and requested that the proposals be circulated to the bench, bar, and public for comment. The proposed amendments, Rules Committee reports explaining the proposed changes, and other information are posted on the Judiciary's website at: http://www.uscourts.gov/RulesandPolicies/rules/proposed-amendments.aspx. The public comment period ends February 15, 2014. Please note that these amendments include a proposed national form Chapter 13 plan, as well as new modernized forms.

Amendments to the Federal Rules of Bankruptcy Procedure, the Official Bankruptcy Forms, and the Bankruptcy Court Miscellaneous Fee Schedule will take effect on December 1, 2013. Please note that motions to sell property free and clear of liens pursuant to 11 U.S.C. § 363(f) will require a filing fee of $176 after December 1.

Credit counseling and financial management courses must be completed through one of the approved providers for the Western District of North Carolina.  The list of approved providers is found under the “information” tab on the Court’s website or directly at
http://www.ncwba.uscourts.gov/credit.html.  Pursuant to 11 USC § 111, providers must be re-approved annually and may be removed at any time.
