Asheville July 16 and July 17, 2013 Court Term Cancelled
Judge Hodges will not hold Bankruptcy Court in Asheville on Tuesday and Wednesday, July 16 and 17, 2013. He has invited attorneys to set hearings on Chambers Days of July 2, 2013 at 10:00 a.m. or August 6, 2013 at 10:00 a.m. The regular term of Court will be held on August 20 and 21, 2013 at 9:30 a.m. If there is a need for a special hearing date, please contact the Clerk’s Office in Asheville at (828) 771-7300 or the judge’s chambers in Charlotte at (704) 350-7575.

New Fee Transfer of Claim $25 per claim transferred
The fee must be paid by credit card upon the filing of the claims transfer in CM/ECF using Pay.gov. An entity that electronically handles claims transfers must ensure that the individual filing a transfer is authorized to pay this fee by credit card. Failure to pay outstanding fees will result in a lockout of the account and or the CM/ECF system.

Revised Dollar Amounts in Official Forms effective April 1, 2013
On April 1, 2013, automatic adjustments to the dollar amounts stated in various provisions of the Bankruptcy Code will become effective. The amended dollar amounts will apply to cases filed on or after April 1, 2013. Seven of the Official Bankruptcy Forms and two of the Director’s Forms contain references to several of the affected dollar amounts. NEW ADDRESS FOR MAILING CHECKS TO CLERK'S OFFICE
Effective March 15, 2013, please mail all checks, money orders, and certified funds to the Charlotte Bankruptcy Clerk’s office for processing. (This includes Chapter 11 quarterly fees and installment payments.) Mail your payments to: U.S. Bankruptcy Court, 401 West Trade St., Room 111, Charlotte, NC 28202. Attorney filers may also submit credit card payments by using Pay.gov.

ASHEVILLE'S MAY 21 AND 22, 2013 COURT SESSIONS - CANCELED
Asheville’s May 21 and May 22 hearing dates are cancelled. To compensate for the cancellation, the May 7 and June 4 Asheville Chambers days are available for scheduling hearings. All hearings will start at 10:00 a.m. on May 7 and June 4.
If there is a need for a special hearing date, please contact the Clerk’s Office in Asheville at (828) 771-7300 or the judge’s chambers in Charlotte at (704) 350-7575.
There will be no Chapter 13 dismissals noticed for hearing on May 21, 2013.

JUNE 2013 HEARING DATES CHANGE
Judge Whitley’s Chapter 7 hearings scheduled for Thursday, June 27 are rescheduled to Monday, June 24.
The Shelby hearings scheduled for Friday, June 28 are rescheduled to Friday, June 21.
The Court will re-notice any hearings currently scheduled on June 27 and June 28 to the rescheduled hearing dates.

The Court has amended its Local Rules of Bankruptcy Practice and Procedure and Local Bankruptcy Forms, and adopted those amendments for inclusion in the Local Rules and Local Forms effective March 1, 2013.

Centralized Processing of Returned BNC Mail Effective October 15, 2012
The Judiciary's Bankruptcy Noticing Center (BNC) contractor will begin accepting, processing and securely disposing of notices that would otherwise be returned to the bankruptcy courts. More Info.

Please Note:
Credit counseling and financial management courses must be completed through one of the approved providers for the Western District of North Carolina. The list of approved providers is found under the “information” tab on the Court’s website or directly at http://www.ncwba.uscourts.gov/credit.html. Pursuant to 11 USC § 111, providers must be re-approved annually and may be removed at any time.
