Adoption of Local Form 8i

Effective March 30, 2021, the court has adopted a new local form, Local Form 8i, for use in Chapter 13 cases.  The Consolidated Appropriations Act of 2021 temporarily added 11 U.S.C. § 1328(i) to the Bankruptcy Code.  Section 1328(i) allows the court to award discharges to Chapter 13 debtors who have not completed their plans in certain circumstances.  Local Form 8i allows these debtors to make the required certifications related to domestic support obligations and 11 U.S.C. § 522(q) without certifying the completion of their plan payments (which is part of Local Form 8) or referring to a hardship discharge (as in Local Form 8HD).  Debtors seeking a discharge pursuant to § 1328(i) should file Local Form 8i with their motions.  The court will discontinue the use of Local Form 8i when § 1328(i) is removed from the Bankruptcy Code.
